As such, predatory trading practices that interfere with the functioning of the real market are prohibited on our platform. Equalh reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will fully cooperate with Equalh in asserting any available defenses.
Arbitration
In the event that the parties cannot resolve any dispute between them arising from these Terms or any provision thereof, whether in contract, tort, or otherwise by law or in equity for damages or any other compensation, then such dispute shall be resolved solely by final and binding arbitration in accordance with the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, at a mutually agreed location.
The arbitrator’s award shall be final and judgment may be entered in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of these Terms and Conditions or relates to them, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims regarding these Terms or any dispute arising from these Terms, whether directly or indirectly, including claims of Tort that result from these Terms. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. The arbitrator shall determine the entire dispute, including the scope and applicability of this arbitration provision. This arbitration provision shall survive the termination of these Terms. Pursuant to other provisions established elsewhere, the laws of the State of Florida shall apply to arbitration proceedings.
If possible, please provide an electronic copy of the complaint or notice to the following email address: support@equalhinc.com
Class Action Waiver
Any arbitration under these Terms and Conditions shall be conducted on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, AND/OR REPRESENTATIVE ACTION, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Additionally, unless you and Equalh agree otherwise, the arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or collective proceeding.

EQUALH INC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. Rule 4.41 of the CFTC:
Inactivity of the account:
An account is considered inactive when it has not registered any type of activity (trading operation) for a period of thirty (30) consecutive days.
After thirty (30) days of inactivity since the last action on the account, Equalh reserves the right to terminate the account. This termination implies the cancellation of access to the trading platform.
Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Additionally, since the trades have not been executed, the results may have overcompensated or undercompensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs, in general, are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
Termination/Access Restriction
Equalh reserves the right, at its sole discretion, to terminate your access to the Site and related services or any portion thereof at any time, without prior notice. To the maximum extent permitted by law, these Terms are governed by the laws of the State of Florida, and you agree to the exclusive jurisdiction and venue of the courts of Miami-Dade County, New Jersey, in all disputes arising out of or relating to the use of the Site, in the event arbitration efforts fail. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, among others, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Equalh as a result of this agreement or use of the Site. Equalh’s performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of Equalh’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided or gathered by Equalh with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Equalh with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Equalh with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be drawn up in Spanish and English.
Nature of User’s Account Employed
Equalh Inc reserves the right to provide, at its own discretion and evaluations, demonstration accounts with virtual money to traders.
Changes to the Terms
Equalh reserves the right, at its sole discretion, to change the terms and conditions under which equal-h.com is offered. The most current version of the terms and conditions will supersede all previous versions. Equalh encourages you to periodically review the terms and conditions to stay informed of our updates.
These changes will take effect as of January 1, 2023.
Prohibited Trading Strategies
Typically, we approve all profitable trading styles, and our clients are widely recognized and accepted. However, we must mention some questionable actions that we cannot support because they cannot be accredited or authorized at Equalh:
– Changing the user password on the virtual money demo account is not allowed. Otherwise, the account would be immediately suspended.
– Account management is not permitted, as we seek to evaluate the skills of our traders individually. The practice of copy trading on one’s own and third-party accounts is expressly prohibited, meaning:
Prohibited Trading Activities:
Traders participating are prohibited from using trading signals from external communities or copying trades from other traders or their own accounts. Failure to comply with this rule will result in the cancellation of the account. Some of the ways we will detect this serious breach include:
– Pattern Analysis: Detecting similar trading patterns among traders. This may include identifying entry and exit points, stop-loss and take-profit levels, and other technicalities used in trades.
– IP and Device Monitoring: Monitoring system to identify more than one account operated from the same IP address/similar devices.
In the event of needing to change the IP, please notify support@equalhinc.com before making any trades and detail the corresponding reason.
Each user can purchase up to $1.000.000 in Equalh accounts, which does not mean they can trade in all accounts with the same strategy. We at Equalh provide the opportunity for a trader to have $1 million in a single account, for convenience, but do not allow the same trading strategy to be copied across all accounts. For example, if a trader opens a position on EURUSD for buying at a price of 1.07750, they cannot open the same position in their other Equalh account. They must seek another pair or instrument to trade differently in all their accounts.
Hedging between trades is also not allowed, meaning buying EURUSD at 1.07750 and selling in another account at the same price within 10 minutes of the trade opening. Nor can traders coordinate with others to do so, as the system can easily detect this.
Thus, each trader can purchase up to $1 million in funding accounts in Equalh, whether it’s buying 2 accounts of $500.000 each or 5 accounts of $200.000 each, depending on the trader’s preference. As long as the trader respects these T&Cs imposed by Equalh, which will be applied effectively without exception.
Third-party trading strategies are prohibited because they are vulnerable and impractical in the real world of the market. Therefore, the market may reject them or we may not accept them to ensure that our traders follow proper funding procedures.
– Strategies that are not traded according to live conditions are not allowed.
– Simultaneously opening positions in opposite directions in different accounts or third-party accounts is prohibited.
– If anyone uses any of the aforementioned strategies, we will close the account, and all compensation will be forfeited.
Some EAs and robots exploit inefficiencies in MetaTrader and C-Trader. Tick scalping, arbitrage, reverse arbitrage, latency arbitrage, hedging arbitrage, or any emulator within the funding stage are prohibited. They can only be used in Equalh HFT to pass the challenge stages, not for the funded stage.
Executing trades using an external or slow data source, EA forms, this restriction will not apply during the evaluation phase.
If you use any software, artificial intelligence, ultra-speed, or massive data input that can manipulate, abuse, or give you an unfair advantage when using our systems or services;
– Executing trades that contradict the way trades are executed in the market or any other financial market, or in a way that raises legitimate concerns that the provider may suffer financial or other damages as a result of the client’s activities.
– Trading is not allowed in the market 20 minutes before and 20 minutes after the release of Class A news, with 3 stars or higher relevance. We will use the following website as the reference for news: https://es.investing.com/economic-calendar
-Fundamental Trading: If you specialize exclusively in fundamental-based trading, it is mandatory to communicate with our team before executing any trades. Only trades of this type will be considered and validated. All trades must be opened manually. The use of limit orders for the purpose of exploiting market conditions is not allowed. Entries must be based on specific strategies rather than market opportunities.
– Additionally, the trader will not exploit the Services by executing trades without applying the usual market risk management rules for trades in financial markets, in addition to, among others, the following practices that open substantially larger positions compared to other trades of the trader, whether in this or any other Client account, or opening a substantially smaller or larger number of positions compared to other trades of the trader, whether in this or any other Client account.
Equalh may delete transactions that violate the Client’s trading history prohibition and/or not account for their results in profits and/or losses obtained through demo trades, or immediately cancel all Services provided to the Client and subsequently terminate this Contract.
If the Client incurs any of the described practices repeatedly, and Equalh has previously notified them, Equalh may prevent the Client from accessing all Services or parts thereof, including access to the Client Section and the Trading Platform, without any compensation. In such a case, the Client shall not be entitled to a refund of any fees paid.
Equalh assumes no responsibility for trading activities or other investment activities conducted by the Client outside the relationship with Equalh, for example, using data or other information from the Client Section, the Trading Platform, or otherwise related to the Services in actual trading in financial markets, even if the Client uses the same Trading Platform for demo trading.
Coherence Rules
- **Drawdown with Equity**: Represents the largest loss experienced in percentage terms from the highest point of the account to the lowest point before the account recovers and reaches a new peak. The account balance must be calculated based on Equity, meaning it is floating and based on the operation with the highest gain. Daily drawdown must not exceed 5% / 3%. Additionally, the total drawdown of the account must not exceed 10% / 7% at any point during the challenge. If these limits are exceeded, the trader will lose the challenge.
- **Mandatory Opening of Trades with Stop Loss and Take Profit**: All trades must be opened with both stop loss and take profit. If a trade is closed prematurely, it must be complete. Otherwise, the trade will not be valid.
- **Consistency in Lot Sizes**: Traders must maintain consistency in the size of their lots throughout their trading process, ensuring that their lot size decisions are proportional to the size of their account and the risk assumed. Trades that fall outside the specified range will be invalidated.
- **Consistency in Trade Duration**: The duration of trades must be consistent with the strategy used, avoiding significant discrepancies between short-term and long-term trades.
- **Avoid Stacking Trades in the Same Pair**: Traders cannot open more than two simultaneous trades in the same currency pair in the same direction. If stacking of trades is detected, the consequence is the cancellation of the account.
- **No Single Trade Representing 50% or More of Total Withdrawal**: Traders cannot have 50% or more of their capital to withdraw in a single trade. This rule ensures that traders do not take excessive risks in a single trade.
- **Limit on Lot Sizes per Trade**: Due to broker policies, a maximum limit of 20 lots per trade is established. Any trade exceeding this limit will result in the trade being cancelled.
- **Lot Consolidation**: If the Trader opens multiple trades of the same instrument within a 15-minute period or less, Equalh reserves the right to consolidate the lot sizes used in all these trades into a single lot size. In other words, the sum of the lot sizes of all trades made within this period will be considered as a single position for financing purposes. This measure is implemented to promote consistent risk management and to prevent practices aimed at manipulating the evaluation. For a first violation of any rule in this section, the trader will be notified as a warning. If the violation is repeated, the account will be closed without any possibility of reclaiming the amount paid for the challenge.
Anti Gambling Rule
This rule aims to establish a clear framework for trading operations on our platform, in order to identify and eliminate those traders who seek quick profits through betting or unprofitable long-term strategies. We seek to foster a professional trading environment where traders focus on proper risk management and building sound strategies for sustainable success.
Gambling in all its forms within Equalh is strictly prohibited. This practice, characterized by impulsive betting, high-risk strategies and the pursuit of quick profits, goes against the fundamental principles of responsible and sustainable trading.
How to identify what you are gambling?
Not having established trading schedules.
Inconsistent risk and profit margins: traders should maintain a consistent position size in relation to their available capital.
The following will be considered gambling strategies:
Repetitive trading with patterns that are not based on fundamental or technical analysis.
Excessively large transactions in relation to available capital.
Any other strategy that, in the company’s judgment, is considered a form of gambling.
Performance monitoring and evaluation:
The company constantly monitors the trading performance of each trader.
Compliance with the established rules will be evaluated, as well as the consistency of results and the application of sound trading strategies.
Traders who violate the rules or fail to demonstrate long-term profitable performance will be notified and their account may be suspended or terminated.
Withdrawal Profit Conditions
Minimum Trading Period Before Requesting Withdrawals:
A minimum trading period of 14 business days is required for Stark and Bot accounts, while Fast accounts require 18 business days from the day the first trade is made before profit withdrawals can be requested. This ensures that you can demonstrate your skill and consistency in trading before accessing withdrawals.
Minimum Trading Days:
In addition to the minimum trading period, traders must have at least 7 trades on different days, with each trade lasting a minimum of 5 minutes to be considered valid. This helps ensure that profits are not simply the result of isolated or random trades but follow a consistent strategy.
Payment Process:
The payment process takes 3 to 5 business days as it is necessary to analyze all your trades before approval. This process includes an interview via video call with questions about your trading, which will be recorded to confirm the trader’s identity.
Maximum Payout Rule:
To ensure responsible and sustainable financial management for both participating traders and the company, a maximum limit for withdrawals is set in relation to the value paid for the account in question. The plan’s objective is to limit the user’s potential gain to 700% for the Stark challenge, 600% for the Bots, and 500% for the Fast Pass, with withdrawals staggered in a minimum of 3 installments based on the price of each challenge.
Refund:
Upon reaching the maximum profit in your challenge (only for accounts opened from 04/01/2024), receive a 100% refund of the original challenge and start a new plan at no cost, or get a 50% refund. If you choose the 50% option, your current account will be closed.
Reminder:
The refund is not automatic. You must request it within 15 days after your account stops generating profits. If not requested within this timeframe, the refund will not be valid. Send your request to payment@equalhinc.com to process it within 5 business days.
This evaluation phase allows us to have a clear view of the trader’s performance and ensure they are trading responsibly before moving on to trading with real funds. By setting a maximum withdrawal limit, we can effectively manage the flow of funds and ensure the financial stability of the funding program. Once a trader demonstrates consistency and profitability in their demo trading and moves on to trading with real funds, they can access the EQUALH PRO program. At this point, there will no longer be a maximum withdrawal limit, as the trader will be considered an integral part of the company and will operate with a higher degree of trust and responsibility.

Risk Disclosure
Liability
All content published and distributed by Equalh Inc (collectively, the “Company”) should be treated solely as general information. No part of the information provided by the Company or contained herein is intended to be (a) investment advice, (b) an offer or solicitation of an offer to buy or sell, or (c) a recommendation, endorsement, or sponsorship of any security, company, or fund. Testimonials appearing on Company websites may not be representative of other clients and are not a guarantee of future performance or success. Trading futures and forex involves substantial risk and is not for all investors. An investor could potentially lose all or more than the investor’s initial investment. Only risk capital (money that can be lost without jeopardizing financial security or lifestyle) should be used for trading, and only individuals with sufficient risk capital should consider trading. Nothing contained herein is a solicitation or offer to buy or sell futures, options, or forex. Past performance is not necessarily indicative of future results.
Demo Accounts
CFTC Rule 4.41: Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under-or-over compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs, in general, are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
High-Risk Warning
Trading contracts for difference (CFDs) on margin carries a high level of risk and may not be suitable for all investors. Before deciding to trade Contracts for Difference (CFDs), you should carefully consider your trading objectives, level of experience, and risk appetite. You may sustain losses exceeding the amount you invest and, therefore, you should not deposit money that you cannot afford to lose. Ensure you fully understand the risks and take appropriate measures to manage your risk.
